DUI Laws in Montgomery County
All DUI charges in Montgomery County fall under VTL § 1192. DWAI at 1192(1) is a traffic infraction for BAC 0.05 to 0.07. DWI per se at 1192(2) is a misdemeanor at 0.08 or higher. Aggravated DWI at 1192(2-a) starts at 0.18. Drug impairment falls under 1192(4).
First DWI conviction carries $500 to $1,000 in fines, up to one year in jail, and license revocation for at least six months.
