How to Search DUI Records in Otsego County
The Oneonta City Court is a major court for DWI cases in Otsego County. Since July 14, 2003, all criminal history searches must go through the OCA Criminal History Search Unit in New York City. The cost is $95 per name. Local courts no longer do their own criminal history lookups.
However, the Oneonta City Court will still do manual searches when you have a case but not the exact arrest date and need a specific disposition. The fee for a manual search is $5.00 per two-year period. Indicate the years to search on your request. For cases before 1990, submit a written request to the Clerk of the Court with the defendant's name, date of birth, years to search, and payment of $5.00 per two-year period in cash or money order.
If you already know the docket number or year of the case and just need the documents, you can skip the search fee. The court provides copies of documents and Certificates of Disposition directly if you have the case details. Bring your ID and be ready to pay copy fees. For statewide searches, the WebCrims system is free for pending cases.
DUI Records Under New York State Law
Under VTL § 1192, DWI convictions in Otsego County show up in the OCA CHRS if they involved fingerprinting and reached a final disposition. Violations-level offenses or cases that got resolved as traffic infractions may not appear. The system has gaps, and you should know about them before relying on a single search.
Sealed records under CPL § 160.50, 160.55, 160.58, or 160.59 will not show in any public search. Dismissed cases get sealed by law. Only the person named can access their own sealed records through DCJS. The fingerprint-based check costs $14.25 and takes three to four weeks. Results are mailed to the person who requested them.
If you cannot afford the DCJS fee, you can ask for a waiver. Email RecordReview@dcjs.ny.gov or write to: Records Review Unit, New York State Division of Criminal Justice Services, 80 South Swan St., 5th Floor, Albany, NY 12210. They will send you a fee waiver application packet. This only applies to checking your own record.
Fees for Otsego County DUI Records
Costs depend on the method you use. The OCA statewide search runs $95. The Oneonta City Court manual search is $5 per two-year period. Copy fees at the Clerk's Office follow state rates. The eCourts portal and WebCrims are free.
For people who qualify as indigent, both the search fee and copy fees can be waived. You need to send the search application and the indigence application to the Criminal History Search Unit in New York City. Do not send them to the local court. This rule applies to OCA searches, not to the Clerk's Office copy fees.
