DUI Offense Levels Under New York Law

A second DWI within ten years is a Class E felony carrying fines up to $5,000 and up to four years in state prison. Leandra's Law makes any DWI with a child under 16 in the car an automatic felony. Dismissed cases get sealed under CPL § 160.50. Once sealed, the records cannot be found in any public database. The court, police, and prosecution must all seal their files. Only the individual named in the records or a court order can access them.
