The Hamilton County Sheriff's Office and New York State Police handle most law enforcement in the county. DUI arrests happen on state routes and local roads throughout the Adirondack region. After arrest, the case goes to the town court where the arrest occurred. If it is a felony, the case transfers to County Court. DUI Charges Under New York Law

VTL § 1192 defines all levels of impaired driving. DWAI at 1192(1) is a traffic infraction for BAC 0.05 to 0.07. DWI per se at 1192(2) is a misdemeanor at 0.08 or higher. Aggravated DWI at 1192(2-a) kicks in at 0.18. Driving under the influence of drugs falls under 1192(4).

First DWI brings $500 to $1,000 in fines, up to one year in jail, and six months of license revocation. A second DWI in ten years is a Class E felony with fines up to $5,000 and prison up to four years. Under Leandra's Law, a DWI with a child under 16 in the car is automatically a felony. Dismissed or acquitted cases are sealed under CPL § 160.50. Once sealed, records do not appear in any public search. The court, police, and DA all seal their copies. Only the named individual can access sealed records, or you need a court order.
