DUI Records and New York Law in Schenectady County

The main DWI statute is VTL § 1192. DWAI under subsection (1) is a traffic infraction. DWI Per Se under subsection (2) is a misdemeanor. Aggravated DWI under subsection (2-a) applies at a BAC of 0.18 or more. First-time DWI penalties include a $500 to $1,000 fine, up to one year in jail, and six months of license revocation.

Second DWI within ten years is a Class E felony with fines up to $5,000 and four years in prison. Leandra's Law makes any DWI with a child under 16 an automatic felony. The DMV tracks penalties separately from court records.

Sealed records affect what you can find. CPL § 160.50 seals dismissed cases. CPL § 160.55 covers certain non-criminal outcomes. When a DWI gets pleaded down to DWAI, the original arrest record may be sealed. Court records access is governed by Judiciary Law § 255, not FOIL. Send requests to the Clerk of the Court.
