DUI Laws in Genesee County
VTL § 1192 defines all DUI offenses. DWAI under 1192(1) is a traffic infraction for BAC 0.05 to 0.07. DWI under 1192(2) starts at 0.08 and is a misdemeanor. Aggravated DWI under 1192(2-a) applies at 0.18 and above. Drug impairment falls under 1192(4) and 1192(4-a).
First DWI means $500 to $1,000 in fines, up to one year in jail, and six months of license revocation. Second DWI in ten years is a Class E felony. When DWI charges are dismissed or a person is acquitted, CPL § 160.50 requires the records to be sealed. This covers court files, police records, and prosecution files. Sealed cases do not appear in any public search. Only the person named in the record can access it without a court order.
