New York DUI Law and Utica
Under VTL § 1192, first DWI is a misdemeanor. Fine of $500 to $1,000, up to one year in jail, and six-month license revocation. Second DWI within ten years is a Class E felony with fines up to $5,000 and up to four years in prison. Leandra's Law makes DWI with a child under 16 an automatic felony.
