DUI Laws That Affect Albany Records

New York uses DWI, not DUI. The main law is VTL § 1192. DWAI under VTL § 1192(1) is a traffic infraction for a BAC between 0.05 and 0.07. DWI Per Se under VTL § 1192(2) is a misdemeanor for a BAC of 0.08 or higher. Aggravated DWI kicks in at 0.18 BAC or above.

A first DWI conviction in Albany brings a fine of $500 to $1,000, up to one year in jail, and a six-month license revocation. A second DWI within ten years becomes a Class E felony with fines up to $5,000 and up to four years in prison. Leandra's Law makes it a felony if a child under 16 is in the car during a DWI arrest.

Sealed records matter for DUI searches. Under CPL § 160.50, dismissed cases are sealed. Under CPL § 160.55, certain non-criminal dispositions may also be sealed. When a DWI gets reduced to DWAI, the original arrest record can be sealed, leaving only the infraction on the public record. Court records access falls under Judiciary Law § 255, which is separate from the FOIL process used for police records.

Albany DUI Resources and Programs

Albany City Court works with the Albany County District Attorney's Office for DUI prosecutions. The court may offer the Drinking Driver Program for first-time offenders as part of reduced charges or sentencing. The DDP is now called the Impaired Driver Program and costs $75 for the DMV application fee plus $225 for enrollment. Completion can lead to a conditional license.

The Albany County STOP-DWI program funds enforcement patrols and sobriety checkpoints. Fines from DWI convictions pay for the program. The county coordinator works with local police, the DA, and probation to reduce impaired driving.

The NYS Court Help page has details on getting court records. The eCourts portal gives access to case info for courts across New York, including Albany courts. For treatment court options, the NYS Treatment Courts page has info on programs that offer alternatives to jail for some DWI defendants.
