New York DUI Laws
VTL § 1192 is the main DWI law. DWAI at 0.05 to 0.07 BAC is a traffic infraction. DWI Per Se at 0.08 or above is a misdemeanor. Aggravated DWI at 0.18 BAC has enhanced penalties. First DWI means a $500 to $1,000 fine, up to one year in jail, and six months of license revocation.
A second DWI within ten years is a Class E felony with fines to $5,000 and up to four years in prison. Leandra's Law makes any DWI with a child under 16 present a felony. These cases move from Islip Town Court to Suffolk County Court. Aggravated DWI with a BAC of 0.18 or higher carries stiffer penalties even on a first offense.
CPL § 160.50 seals dismissed cases. CPL § 160.55 covers records when DWI is reduced to DWAI. Court records are under Judiciary Law § 255, not FOIL. Police records need a separate FOIL request. Only the person arrested can get sealed records from DCJS. Acquittals and dismissals are sealed right away, so they will not appear in public searches.
