DUI Laws and Brookhaven Court Records
VTL § 1192 is the main DWI law. DWAI at 0.05 to 0.07 BAC is a traffic infraction. DWI at 0.08 or above is a misdemeanor. Aggravated DWI at 0.18 BAC or higher carries stiffer penalties. First DWI means a $500 to $1,000 fine, up to a year in jail, and six months of license revocation.
A second DWI within ten years becomes a Class E felony with fines up to $5,000 and up to four years in prison. Those cases go from Brookhaven Town Court to Suffolk County Court. Leandra's Law makes any DWI with a child under 16 in the vehicle a felony. All DWI convictions require ignition interlock device installation. Aggravated DWI at 0.18 BAC carries enhanced penalties even on a first offense.
Sealed records limit what you can find. CPL § 160.50 seals dismissed cases. CPL § 160.55 may seal records when a DWI gets reduced to DWAI. Court records are accessed under Judiciary Law § 255 rather than FOIL. Only the person arrested can get their own sealed records from DCJS. Acquittals are also sealed automatically. This means a public search may not reveal cases that ended without a conviction.
