DUI Records and New York Law in Tioga County

VTL § 1192 is the main DWI statute. DWAI is a traffic infraction. DWI Per Se is a misdemeanor at BAC 0.08 or above. Aggravated DWI starts at 0.18 BAC. First DWI brings a $500 to $1,000 fine, up to one year in jail, and six months of license revocation.

Second DWI in ten years is a Class E felony with fines up to $5,000 and four years in prison. Leandra's Law makes a DWI with a child under 16 an automatic felony. The DMV tracks license penalties separately.

CPL § 160.50 seals dismissed cases. CPL § 160.55 covers non-criminal outcomes. Court records access falls under Judiciary Law § 255, not FOIL. The NYS Court Help page explains the full process for accessing court records.

Tioga County STOP-DWI and Resources

Tioga County runs a STOP-DWI program funded by DWI fines. The program supports enforcement patrols and education throughout the county. The Sheriff's Office participates in coordinated enforcement efforts with the DA's office. Saturation patrols and sobriety checkpoints are common during holidays and other busy travel times in the Southern Tier area.

A DUI record in Tioga County includes the arrest date, arresting agency, BAC test results, court dates, plea deals, and the final disposition. For felony DWI cases at County Court, the file also has grand jury proceedings and sentencing documents. When a DWI gets reduced to DWAI through plea negotiations, the original arrest record may be sealed under CPL § 160.55. Only the arrested person can access their sealed records through DCJS for $14.25.

The DMV tracks its own records separately from the court system. License revocations, points, and ignition interlock requirements under Leandra's Law are on the DMV record, not the court record. You need both to get the full picture of any DUI case.

The DCJS website has more information on criminal justice records in New York. For defense resources and treatment programs, the county court system may refer appropriate defendants to treatment alternatives.
