DUI Laws Applied in Jefferson County

VTL § 1192 is the main DUI statute. DWAI at 1192(1) covers BAC 0.05 to 0.07. DWI per se at 1192(2) applies at 0.08 or above. Aggravated DWI at 1192(2-a) starts at 0.18. Drug impairment is 1192(4). Combined drug and alcohol impairment falls under 1192(4-a).

First DWI is a misdemeanor with $500 to $1,000 in fines, up to one year in jail, and at least six months of license revocation. A second DWI in ten years is a Class E felony. CPL § 160.50 requires sealing of records when charges are dismissed or the defendant is acquitted. All records are sealed: court files, police reports, and prosecution files. Sealed records cannot be found through any public search. Only the individual named in the records can access them, or you need a court order.
