Yonkers City Court and DUI Case Filing

The Yonkers City Court is at 100 South Broadway, Yonkers, NY 10701. The Yonkers Police Courts Unit helps move criminal, traffic, and civil cases through the system. The Criminal Case Review Office researches cases, pulls criminal histories, and gets DMV information for both the courts and the DA's office.

Seven different courts operate at once in Yonkers. The Traffic Case Review Officer schedules officers for traffic case hearings and trials. All misdemeanor DUI charges under VTL § 1192 are processed here, including DWAI, DWI Per Se, and Aggravated DWI. Felony cases transfer to Westchester County Court in White Plains.

The court handles arraignments, plea proceedings, trials, and sentencing. Copy fees are $0.65 per page for regular copies and $8.00 for certified documents. The Courts Unit also manages the Property and Evidence Unit and the Records Section.

The OCA Criminal History Record Search costs $95 per name. It covers all courts in all 62 counties, including Yonkers City Court. You need exact legal name and date of birth. Results come in real time when no records exist. Records found go through manual review taking up to five business days. CHRS results are not certified.

For police reports from DUI arrests, go to the Yonkers Police Records Section on the second floor of the Cacace Justice Center at 104 South Broadway. Hours are Monday through Friday, 9:00 AM to 3:00 PM. For non-motor vehicle accident reports by mail, send a copy of your government-issued ID, a $2 non-refundable search fee, and a self-addressed stamped envelope. Include the incident number, date, location, and type of incident. Most reports are available within eight business days.

Important: if a case is an open investigation or open with the DA's office or court, the report cannot be released. If a record has been sealed by the court, the police department cannot release it either. The Records Unit does not fax or email reports.

DUI Records Fees

The Westchester County Clerk at the Daronco Courthouse, 111 Dr. Martin Luther King Jr. Blvd, White Plains, charges $5.00 per name for a two-year search. Call (914) 995-3080. Hours are Monday through Friday, 8:30 AM to 4:30 PM. Certified copies are $10.00. Regular copies are $0.65 per page. Free public access terminals are in the lobby.

New York DUI Law in Yonkers

Under VTL § 1192, first DWI is a misdemeanor. The fine is $500 to $1,000. Up to one year in jail. Six-month license revocation. A second DWI within ten years is a Class E felony with fines up to $5,000 and up to four years in prison. Leandra's Law makes DWI an automatic felony when a child under 16 is in the car.

CPL § 160.50 seals dismissed cases immediately. CPL § 160.55 may seal the arrest record when DWI gets reduced to DWAI through a plea deal. This happens often in Yonkers City Court. Sealed records don't appear in OCA searches or at the clerk's office. Only the arrested person can access sealed records through DCJS. Judiciary Law § 255 controls public access to court records.

DMV Records and Penalties

The DMV tracks DUI penalties on driving abstracts. DWI stays 15 years. DWAI stays 10. Refusing a chemical test triggers automatic one-year revocation and $500 civil penalty. You have 15 days to request a refusal hearing. The Impaired Driver Program costs $300 total and may get you a conditional license.
