DUI Laws Affecting Hempstead Records

VTL § 1192 covers all DWI offenses. DWAI at 0.05 to 0.07 BAC is a traffic infraction. DWI Per Se at 0.08 or above is a misdemeanor. Aggravated DWI at 0.18 BAC or higher carries enhanced penalties. First DWI means $500 to $1,000 in fines, up to a year in jail, and a six-month license revocation.
